Elizabeth Barrett concentrates her practice in the areas of Banking and Finance, Real Estate, and Business Law. She regularly assists various types of lending clients, including small community banks, large regional and national banks, and non-bank lenders. She has extensive experience with structuring, documenting, negotiating, and closing a wide range of complex loans for commercial real estate transactions, commercial and industrial loan transactions, and U.S. Small Business Administration (SBA) and other government-guaranteed loan program transactions.
Often under significant time constraints and other pressures, Elizabeth diligently works with each lender and borrower to facilitate complex loan transactions, such as bank lending, property finance, project finance, acquisition finance, and asset-based finance. Elizabeth prioritizes successfully reaching a common goal for everyone involved while ensuring lenders’ interests are met and adequately secured.
As part of her lending practice, Elizabeth has experience advising lenders regarding the creation, attachment, perfection and priority of security interests and other uniform commercial code issues as well as providing guidance to lenders on statutory and common law liens that may impact the priority or enforcement of lenders’ expected security interest. She also has experience assisting lenders with managing the challenges associated with tenant in common structures, reverse 1031 transactions, unique collateral, and SBA loan programs’ special purposes and requirements.
